Greater Vancouver Sewerage District, 2021 SCC 7 (“Wastech”) provides guidance on the nature and scope of the duty of good faith when exercising discretionary contractual powers. The Court re-affirmed what many franchise law practitioners have been telling their clients for years; that this discretion must be exercised reasonably within the purpose for which it is granted.
